AXIONICS — Processing of personal data.

This English text is a courtesy translation. Only the French version, available at /confidentialite, is legally binding.

This policy describes how AXIONICS collects and processes the personal data of visitors to fresh-circuit.org and of its clients and prospects, in accordance with Regulation (EU) 2016/679 (the « GDPR ») and French Act No. 78-17 of 6 January 1978 as amended.

1. Data controller

The data controller is AXIONICS, a SASU with share capital of €200, registered with the Paris trade register under number 921 627 931, whose registered office is at 60 rue François Ier, 75008 Paris, France, and whose place of business is at 4 rue Henri Tagnères, 31400 Toulouse, France.

For any question regarding your data: hello@fresh-circuit.org.

2. Data collected and purposes

AXIONICS collects only the data strictly necessary for the following purposes.

2.1 Contact form

The name, email address, subject and message fields are collected in order to handle and answer your enquiry. Providing this data is necessary to process the enquiry; without it, the enquiry cannot be dealt with.

2.2 Appointment booking

The booking page embeds the Cal.com service. The data you enter there (name, email address, selected slot and any additional information you provide) is processed in order to arrange the meeting.

2.3 Contractual relationship

In the course of performing the Services, the identification and billing data of the Client and its contacts (name, role, business contact details, billing information) is processed for the purposes of managing the quotation, the contract, invoicing and the ongoing relationship.

2.4 Audience measurement and technical logs

The site uses Umami, an audience measurement solution self-hosted by AXIONICS on its own domain. Umami operates without cookies and performs no individual tracking and no cross-site correlation. The resulting statistics are aggregated.

In addition, the servers hosting the site record technical logs (IP address, date and time of the request, page requested, browser type) for security and operational purposes.

3. Legal bases

  • Contact form and appointment booking: performance of pre-contractual measures taken at your request (Art. 6(1)(b) GDPR).
  • Contractual relationship: performance of the contract (Art. 6(1)(b) GDPR) and compliance with legal obligations, in particular accounting and tax obligations (Art. 6(1)(c) GDPR).
  • Audience measurement and technical logs: the legitimate interest of AXIONICS in understanding traffic to its site and keeping it secure (Art. 6(1)(f) GDPR).

4. Recipients and processors

Data is never sold, rented or transferred to third parties for commercial purposes. It is accessible only to the legal representative of AXIONICS and, within the limits of their respective assignments, to the following providers:

  • Hetzner Online GmbH (Germany) — hosting of the site and of the related processing.
  • Cal.com, Inc. — appointment booking service, for the data entered when making a booking only. This provider may process data outside the European Union; such transfers are governed by the European Commission's standard contractual clauses.
  • The accountant and, where applicable, the advisers of AXIONICS, for billing data only.

Data submitted through the contact form is processed using an automation platform self-hosted by AXIONICS and does not pass through any third-party service.

5. Data location

The site and the processing operations carried out by AXIONICS are hosted within the European Union. The only transfers outside the European Union that may occur are those referred to in section 4.

6. Retention periods

  • Contact and booking enquiries that did not lead to a contractual relationship: three (3) years from the last contact.
  • Contractual, accounting and billing data: ten (10) years from the close of the financial year, in accordance with Article L.123-22 of the French Commercial Code.
  • Server technical logs: six (6) months.
  • Traffic statistics: twenty-five (25) months, in aggregated form.

7. Cookies

The site sets no advertising cookies and no tracking cookies. The audience measurement described in section 2.4 is performed without cookies. A single local storage entry is used to remember your display preference (light or dark theme); it is strictly necessary for the site to function and does not require your consent.

8. Security

AXIONICS implements appropriate technical and organisational measures to protect data against destruction, loss, alteration or unauthorised access, in particular encryption of communications (HTTPS), restricted access and minimisation of the data collected.

9. Your rights

Under the conditions laid down by the GDPR, you have the rights of access, rectification, erasure, restriction, objection and portability in respect of your data, as well as the right to give instructions concerning its fate after your death.

These rights may be exercised by email at hello@fresh-circuit.org or by post to the registered office. You may be asked to prove your identity. AXIONICS replies within one (1) month of receiving the request.

If, after contacting us, you consider that your rights have not been respected, you may lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France — www.cnil.fr.

10. Changes to this policy

AXIONICS reserves the right to amend this policy to reflect changes in its processing activities or in applicable law. The version in force is the one published on the site at the time of your visit.
